Findings, under II. 2., "Water will be monitored for water quality <br />and quantity in general places on Rapid Creek and the Colorado River..." <br />Powderhorn Coal Company will monitor the flow (quantity) of Rapid <br />and Cottonwood Creeks but not the flows (quantity) of the Colorado <br />River. Powderhorn Coal Company will monitor the quality of the NPDES <br />Discharge Points and the Colorado River but not the quality of water <br />in Rapid Creek, as no surface activities warrant quality monitoring. <br />14. Findings, under II. 6., Powderhorn Coal Company believes this para- <br />graph should be deleted as one violation NOV 82-51 was vacated, NOV <br />82-49 was substantially reduced and Powderhorn Coal Company had no <br />knowledge that "The State is considering extending the deadline for <br />abatement beyond the holidays due to the curtailed staff at the mine." <br />15. Environmental Assessment Page 1, under Introduction: The fourth <br />paragraph, second sentence reads, "1,100,000 tons of raw coal per <br />year." This statement should read, 1,100,000 tons of clean coal per <br />year. <br />16. Environmental Assessment, Page 9, under Probable Hydrologic Consequences- <br />Alluvial Valle Floors, The second paragraph of page 9, second <br />sentence reads, "T ere would be no surface disturbing activities on <br />the AVF, and the area will be undermined." Powderhorn Coal Company <br />will not undermine any portion of this AVF as the coal seam outcrop <br />is substantially dislocated from the AVF. <br />17. Environmental Assessment, Page 10, under Cumulative Hydrologic Impacts <br />the first paragraph, the fifth and sixth sentences should be deleted. <br />The sentences indicate that information and documentation is available <br />for the Blue Flame Mine. Powderhorn Coal Company is not aware of any <br />evidence that would indicate that the mine is hydrologically connected <br />due to the effects of subsidence. Furthermore, Powderhorn Coal Company <br />is not aware of any records that indicate subsidence has occurred <br />or is occurring at or near the Blue Flame Mine. If this information and <br />documentation is available at the Office of Surface Mining, it should <br />be afforded to Powderhorn Coal Company. <br />
