Some of the items <br />have been discussed with Mr. Allen Czarnowsky over the telephone and with <br />Mr. Eldon Strid during a visit to Steamboat Springs by members of the Division <br />staff. We are restating these concerns in this letter and request Mr. <br />Czarnowsky and yourself to address them as soon as possible in order to <br />further the finalization of the Coal Gulch Permit Application Review. <br />If you have any questions, please feel free to contact me. <br />Hydrologic Concerns <br />Mr. Czarnowsky has received a copy of the memorandum regarding the <br />hydrologic concerns identified by Ann Baldridge of our staff. I am <br />also enclosing a copy of that draft memorandum to you with this letter. <br />2. Tlie Division requests that Peerless Resources provide a pond treatment <br />plan for the sediment pond at the Coal Gulch Mine, given the quantity <br />and quality of types of effluent from the old Arness-McGriffen Portal. <br />3. The Division feels that subsidence will occur upon abandonment of the <br />Coal Gulch Mine. This subsidence will affect the Cliff House <br />Sandstone, which is probably contributing water to the Arness/McGriffin <br />Mine. A discussion regarding probable portal, discharge (quantity and <br />quality) is necessary. <br />4. The Division feels that the first ephemeral drainage above the mine <br />will be subsided after mining. It is thought that this subsidence will <br />cause inflows in to the mine during spring runoff, and that the <br />discharged water will be of poor quality. The applicant needs to <br />discuss mitigation of this problem, either by treatment of the water <br />upon discharge, or by creating a non-subsidence zone. <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
