PROPERTIES TO Chandler Creek Property". It incorrectly states that the cun•ent use of the property at
12000 Auckland Avenue owned by Gary W. and Karen E.(R) Zak is "Vacant Residential". We have
been living in our house since June 1, 2005. Also in error is property of Ravensberg, John A. The same
enclosure states that his property is also "Vacant Residential'. I know that these wonderful neighbors of
mine have been living in their home for at least a year longer than my wife and I have lived in ours.
Subsequent to my review of the Northfield Mine Permit, I have some questions and requests:
(I) When is it required, if at all, that the Northfield Mine Project notify property owners in the Chandler
Heights subdivision that we are included in their mine permit and that they plan to dig under our
property?
(2) I agree with Mr. Overton's conclusion in his email that "Although the mine company may feel the
wells (to the south an in the mine permit area) will not be impacted, the permit needs to include a
definitive plan to replace any water lost (contamination loss as well as water table loss, or well damage
due to subsidence etc.) in a timely fashion. Because the wells serve private homes and animals, water
replacement on a temporary basis should occur within 48 hours and on a permanent basis within 30
days." Expect, I believe that water should be replaced within 24 hours vice 48 hours. In addition to Mr.
Overton's request for "a definitive plan to replace any water lost", I request that the Division of
Reclamation, Mining, and Safety, Department of Natural Resources require Northfield Mine Project to
develop a new hydrology report to include all wells in the mine permit azea and all wells to the south
and especially in the Chandler Heights subdivision. This new hydrology report should be completed
before any further public meetings or heazings are held at the local, county or state level regarding this
subject mine permit.
(3) I request that you require Northfield Mine to correct the errors Tab "B" and do a thorough review of
the mine permit application for additional errors before any further public meetings or heazings are held
at the local, county or state level regarding the subject mine permit so that those in authority can make
proper decision based on current fact.
(4) I concur with Mr. Overton in all aspects of his email to you regarding private wells, County Road 79,
noise, dust, etc. pollution, potential residential damages, and the need to keep everyone concerned
informed about all meetings regarding the proposed mine.
Having served this county for 26 years in the US Navy, I know that the granting of this mine permit is a
large task. I have read the permit and am aware of all the time, energy and money that has gone into this
mine permit application. Making decisions that impact peoples lives for the next 15 to possibility 30
yeazs or more is not an easy assignment. Please take care in what you do. Please consider whether you
would want this coalmine to be literally in your backyard. It is remarkable to me that the interests of the
residence of Chandler Heights subdivision were never considered or mentioned in the Northfield Mine
Project. To permit the placing of a coal mine in and amongst residential areas must take into
consideration all the citizens of this great state and not just the mining interest alone. I ask you to
consider the life, liberty and pursuit of happiness of all your citizens when considering this application.
Gary Zak
----- Original Message ----
From: "Gorham ,Kent " <kent.gorham@state.co.us>
To: "chuck@phulmonty.com" <chuck@phulmonty.com>; mstie@fremontco.com;
bgior@fremontco.com
Cc: Barbaza & Larry Minogue <bsmeton@aol.com>; Berle and Beth Thompson
<bgthompson@evl.neV; David & Joann Hawk <joanddavid@earthlink.net>; Gary Zak
<garyzak@sbcglobal.net>; Jason and Pam Drummond <pamelajo66@hotmail.com>; John and
Vancellen Ravensberg craven@vancellen.com>; Kazen Berteau_Fry <kjdb_fry@peoplepo.com>; kazen
11/24/2006
