We also concurred with your observation that <br />the public notice incorrectly identified the location of the intersection of the haul road/access road with County <br />Road 79. We notified the applicant and instructed them to correct and re-publish the notice four times in the local <br />paper as required. <br />You have acknowledged that you have been notified of a public hearing. Notification will also be published in the <br />Canon City Daily Record two weeks prior to this hearing as required. <br />The application is deficient regarding the required information concerning the registered wells in the southern <br />portion of the permit area. We are currently conducting our adequacy review and will have questions for the <br />applicant concerning water rights, registered wells, potential impacts, and replacement of water supplies in the <br />event of impacts. <br />It appears the both the map and Tab B may have errors, omissions, or inconsistencies regarding land use and <br />ownership. This is not uncommon in this situation and we will ask that the map and Tab B be brought up-to-date. <br />In particular, the Location of man-made structures is very important regarding subsidence protection and <br />monitoring. <br />The applicant is required to provide 6 months notice prior to under mining property. <br />The application will not be corrected prior to the public hearing on December 12t^. However, corrections and <br />compliance with all applicable Rules will be completed prior to any proposed decision issued by our Division. <br />Please be aware that many Division staff members with a wide variety of expertise and background are reviewing <br />this application carefully. The entire process is in the very early stages and will take many months to complete. <br />Thank you for you comments we appreciate and acknowledge your interest and concerns.
