Our initial <br />review indicates that seven items required by the Colorado Surface Coal Pfining <br />Reclamation Act, C.R.S. 1973 34-33-101 et seq. and the regulations promulgated <br />pursuant to the Act have not been submitted; thus year application has been <br />deemed incomplete for the purposes of filing on this date. <br />The completeness review identified deficiencies in the application where re- <br />quired data was not submitted or insufficient information was presented for <br />the Division to continue the review process. Since it is the Division's intent <br />to complete the review of the this application within the statutory time frame <br />of 120 days any data gaps which exist where collection and/or analysis of <br />data could extend beyond the 120th day must be identified upon permit submittal. <br />With this in mind several sections were identified as incomplete. Colorado <br />Yampa Coal Company (CYCC) may have the data currently available which could be <br />submitted or could state that the data is shortly forthcoming to complete the <br />application. The following requirements must be addressed and sufficient in- <br />formation presented so that the Division can progress with the adequacy review. <br />1. Rules 2.05.2(2) and 2.10.3(I)(c) - Estimated Area for Life of Operation <br />Colorado Yampa Coal Company has not identified on a map or in the text <br />the estimated area for~the life of the operation. Zn past meetings, <br />CYCC has said the Foidel Creek Mine is a pilot project which may or <br />may not be developed. The application states, however that the planned <br />mining at the Foidel Creek operation will "involve approximately thirty <br />(30) years at mining beyond this property." <br />The designation of the Zife of the mine permit boundary will have <br />implications on the Probable Hydrologic Consequences (PHC)and the Cumulative <br />Nydrolgoic Impact Statements (CRIB). If this is only a 5-year pilot <br />project on the Ti eken Lease the PHC and CHIS can be limited in nature. <br />
