Preliminary Adequacy Review <br />Bear Coal Co., Inc. - Bear Mine <br />Page Four <br />2. A11 sample points used in the analysis must he indicated on the soils map <br />No. 2.04.9(1)(c)-1. <br />2.04.10 Vegetation Information <br />I. The surface disturbance at Bear Mine is limited to approximately 19 acres, with <br />no additional disturbance proposed for the permit term. Therefore, the vegetation <br />map required by 2.04.10(1) is not applicable. <br />2. The applicant has included a small scale vegetation map of the entire permit <br />area and a brief discussion of two vegetation types (wet mixed shrub and riparian) to <br />meet the requirements of 2.04.10(3) and 2.09.10(4), respectively. The extent of the <br />two types discussed on page 55 should be indicated on the vegetation map. The <br />applicant should explain why these two plant communities were discussed, while none <br />of the communities indicated on Drawing No. 2.04.10(1) were described. <br />4.1I Fish and Wildlife Information <br />A misunderstanding exists in relation to the fish and wildlife investigation. Bear <br />Coal Company is the party responsible for obtaining on-.site information, not the <br />Division. The Division can only determine the detail that needs to be investigated. <br />Since most initial impacts to wildlife have already occurred and no further disturbances <br />of the surface is planned, no further baseline information needs to be submitted. <br />Bear Coal Company contacted the Division of Wildlife. The major concern raised by <br />the D.O.W. was possible contamination of the North Fork from coal waste and coal <br />stockpiles on the mine site. These issues are addressed under 2.05.4 of this letter. <br />2.04.12 Prime Farmland Investigation <br />Based on the information provided by Bear Coal Companu, the Division has made a <br />negative determination, concluding that the land to be affected by Bear Coal's <br />mining operat.i.ons is no*_ prime farmland. <br />2.05 Operation and Reclamation Plan <br />2.05.2 One ration Plan <br />Due to recent limitations to the life ~f Bear Coal Mine, all sections related to <br />timetables, amount of production and the extent of proposed underground workings <br />must be revised. <br />2.05.3 Mine Facilities <br />1. A detailed plan of removal of all mining facilities must he supplied. ARCO has <br />indicated in recent correspondence that they do not want to retain any of the Bear <br />Mine facilities, roads or diversions. <br />2. The applicant stated that the railroad siding is owned by the Denver and Rio <br />Grande Railroad. A letter of agreement that the railroad will assume reclamation <br />responsibility for this area must be provided or a reclamation plan must be submitted <br />by Bear Coal Company for this area. <br />
