<br />-z- <br />B. Scope: <br />OSM and CMLRD will jointly develop a scope of work for a study of the <br />potential cumulative hydrologic impacts of all anticipated mining in the <br />general area of the proposed Foidel Creek Underground Mine and Seneca II-W <br />Mine. <br />1. CMLRD will contract for a cumulative hydrologic impact study of the <br />proposed Foidel Creek Underground Mine and Seneca II-W Mine. The study is to <br />include the cumulative effects of mining on two tributaries of the Yampa <br />River: Trout Creek and Dry Creek. A sufficient reach of the Yampa River <br />should be included to evaluate changes in concentration and load. In <br />addition, the study should evaluate the probable cumulative impacts on ground <br />water resources in the Twentymile Park Area through use of existing data and <br />available solute transport model simulations. The study is to include an <br />analysis of the impacts of the subject mines and all appropriate existing and <br />anticipated mining. <br />2. The contractor is to prepare a report describing the results of <br />their analysis, two copies of which are to be delivered to OSM. <br />ARTICLE IV. PAYI4ENT. USM agrees to pay 5090 of the contract costs <br />attributable to the study, $27,500.00. CMLRD agrees tc forego any overhead <br />charges that might be applicable. OSM will provide fur~ding in the form of a <br />letter of credit. <br />ARTICLE V. REPORTS. Under this cooperative agreement, the State will be <br />required to submit ten (10) copies of the final contractor's report and <br />two (2) copies of the draft report. In addition, a final Financial Status <br />Report (SF 269) will be required. Copies of all of the contractor's requests <br />for payment should be attached to the final Financial Status Report. <br />ARTICLE VI. CIVIL RIGHTS. The State agrees to comply with Title VI of the _ .. <br />Civil.Rights Act of 1964 (42 U.S.C. 2000) and all requirements imposed by or <br />pursuant to the regulations of the Department of the Interior entitled <br />"Non-discrimination in Federally-Assisted Programs oaf the Department of the <br />Interior-Effectuation of Title VI of the Civil Rights Act of 1964" (43 CFR <br />Part 17) and shall give assurances of compliance in such forms as may be <br />required by the Director. <br />ARTICLE VII. PERFORMANCE PERIUD. The period of performance of this Agreement <br />is: January 24, 1983 through June 15, 1983, with initial deliverable due on <br />April 15, 1483, a draft report {two copies); followed by the final report June <br />15, 1983 (ten copies). <br />
