-•1 <br />U.S. Department of the Interior <br />Office of Surface Mining <br />Cooperative Agreement <br />Cumulative Hydrologic Impact Study <br />Proposed Foidel Creek Underground Mine and Seneca II-W Mine <br />State: Colorado No. Value: $27,500.00 <br />Designated Agency: From: January 24, 1983 To:June 15, 1983 <br />Colorado Mined Land Reclamation <br />1313 Sherman Street <br />Denver, Colorado 80203 <br />ARTICLE I. GENERAL STATEMENT. The United States of America, represented by <br />the Director or his authorized designee, Uffice of Surface Mining Reclamation <br />and Enforcement (OSM), United States Department of the Interior; and the State <br />of Colorado, represented by the Director or his authorized designee, Colorado <br />Mined Land Reclamation Division (CMLRD, hereinafter referred to as the State); <br />mutually agree to perform this agreement in accordance with the Surface Mining <br />Control and Reclamation Act of 1977, Public Law 95-87, with the regulations by <br />OSM as set forth in 30 CFR Chapter VII, policies, guidelines and requirements <br />including OP1B Circulars No. A095, A-102, FMC 74-4, and Treasury Circular 1075 <br />as related to the acceptance and use of Federal funds for this cooperative <br />agreement. <br />In consideration of the promises made herein by the State, the United States <br />hereby promises to obligate to the State the amount of money set forth above <br />as the total cooperative agreement amount. It is understood that this amount <br />represents the total amount and that overhead will not be charged by the State <br />ARTICLE II. AUTHORITY. This agreement is entered into pursuant to Section <br />201 c 1 12 and 13) of the Surface Mining Control and Reclamation Act <br />(SMCRA) of 1977,, Public Law 95-81; and Sections 6(1), (2), and 7(a) of the <br />Federal Grant and Cooperative Agreement Act of 1971, Public Law 95-244. <br />ARTICLE III. PURPOSE, SCOPE AND SPECIAL PROVISIONS. <br />A. Purpose: <br />In accordance with the Section 523(c) Cooperative Agreement entered into <br />by the State of Colorado, represented by the Colorado Mined Land Recalmation <br />Division (CMLRD), and the Department of the Interior, represented by the <br />Uffice of Surface Mining (OSM), the State will study the cumulative hydrologic <br />impacts of all anticipated mining in the general area of the proposed Foidel <br />Creek Underground Mine and Seneca II-W Mine, both located on the eastern Yampa <br />River Basin. <br />
