Dale Larsen, President Peerless Resources, Inc. 5528 Indian Rock Road Salt Lake City, Utah 84117 Re: Coal Gulch Mine Permit Application - File No. C-084-067 Dear Mr. Larsen: The Division has reviewed your permit application for the Coal Gulch Mine, received on August 30, 1984, and has found it incomplete. The following items must be provided in order for the Division to continue its review: 1) Rule 2.03.4(4) requires that any person identified under 2.03.4(2)(c) (in this case Mr. L. Dale Larsen) must provide a statement of any current or previous surface coal mining permits and of any pending permit applications. Since Mr. Larsen is affiliated with the Durango Coal Company he must provide the required information as it pertains to that company. 2) Rule 2.03.6 - Right of Entry requires a description of the documents upon which the applicant bases his or her legal right to enter and begin surface coal mining operations in the permit area. Exhibit 1 of the application describing these rights for the Durango Coal Company, but makes no mention of the applicant - Peerless Resources, Inc. 3) Rule 2.03.9 requires that as part of the permit application, a certificate certifying that the applicant has a public liability insurance policy in force for the surface coal mining and reclamation operation for which the permit is sought shall be submitted. No certificate has been provided. 4) The Department of Health Emission permit was issued to Arness-McGriffin Coal Company. This permit shall not be transferred without approval of the Air Pollution Control Division.
