<br />SUBLEASE AGREEMENT <br /> <br />THIS SUBLEASE AGREEMENT, made and entered into <br />this 28th day of July 1976, in triplicate, by and <br />between UNITED STAPES STEEL CORPORATION, a Delaware corporation, <br />hereinafter referred to as the "FIRST PARTY," and SUNFLOWER <br />ENERGY CORPOPJaTION, a Co.l~ra~lo corporation, hereinafter <br />referred to as the "SECOND PARTY;" <br />WITNESSETH- <br />WHEREAS, FIRST PARTY and the predecessors in interest <br />to SECOND PARTY have executed a certain contract entitled <br />"Agreement of Sale" dated March 8, 1956, which provided in <br />Paragraph 5 thereof that under certain conditions and upon <br />written request of the parties designated as "Sellers" therein <br />or their successors in interest, FIRST PARTY would execute and <br />deliver to said "Sellers" or their successors in interest a <br />sublease granting the exclusive right to mine, extract and <br />ship coal from the seam locally known as the "Hawksnest Coal <br />Seam" or tl,e "E Coal Seam" and all coal scams nbovc Lh~~t sc~_,m, <br />if any, in a tract of land adjacent to the property then <br />locally known as the Blue Ribbon Mine property and included in <br />any federal coal lease or leases acquired by FIRST PARTY within <br />twenty years after the date of c~::ecution of said A~;rcemcnt of <br />Sale ~,rovidr~d Lhat miy such tract of land sn =:uhlras;~~~1 steal l <br />noC ~_>:cc,.~cl 1;0 „crcr,; an,l <br />L:'HEREAS, those certain conditions capresscd in said <br />Paragraph 5 referred to above have been satisfied and proper <br />written request for said sublease has been made by the pre- <br />decessors in interest to SECOND PARTY (who were the successors <br />in interesC to said "Se].7urs" at the tirnc of sni.d rc,lncst) to <br />FIRST PARTY, by letter ,:~+Led October 3, 1975; and <br />United States of America UEC 1 1976 <br />Sublease approved effective _ <br />hieP Ul ir;t~n at• NOV 15 19761 <br />Technical.
