Lorencito Mine <br />November 9, 2000 <br />Page 2 <br />Railroad. Please provide details concerning any ownership, right-of-way ngreements, and <br />lease arrangements related to coal tr•nrrsport from the proposed Lorencito Canyon Mine acrd <br />New Elk processing site, <br />Response <br />The applicant indicated the railroad agreements would be submitted by December 15, 2000. <br />A[ this time, the Division has not reviewed any agreements, nor have any been submitted. <br />This question remains outstanding. <br />4) Why would reclamation operations at the New Elk site not occur during the winter season? <br />Activities such as structural demolition could occur. We understand that reclmrtntion is <br />planned and that n reclamation contractor has beetr retained. We also understand that the <br />londout structures hove been sold. Please discuss these issues in detail. <br />Response <br />The applicant provided brief discussion concerning reclamation of New Elk. Given the <br />circumstances of potential plans and timeframes, this issue may be moot. I believe the <br />response is adequate. <br />5) Please update the status of any and all surface and mineral right -of--entry tense ngreements <br />for the proposed Lorencito Canyon Mine. Atty charges to the previously approved permit <br />must be processed as n revision, if an extension is granted. <br />Response <br />The applicant is working on securing and /or updating any required right-of-entry <br />information or lease agreements. This new information would be submitted with the permit <br />O revision on Mazch 1, 2001. However, if the applicant would wan[ to begin mining under the <br />currently approved plan with some minor modification, I think that we should get some <br />confirmation that the previous lease arrangement is still valid regarding right-of-entry. <br />Therefore, additional information may be required concerning this question. <br />6) Provide updated ownership and cattroller information for Lorencito Coal Company, A.P. <br />Mnxzvell and Picketwire Processing, including all coal mitring operations for w{riclr Bruce <br />Addington is currently nn owner/controller. A revision will be required for the Lorencito <br />Canyon Mine permit if ntt extension is granted. A revision to the Pickenvire Processing <br />permit should be submitted itrtmediately if the currently approved ownership acrd control <br />information has changed. <br />Question #3 of the Mid-term review requested new owner and controller information. We <br />now have this information indicating 100% ownership by Bruce Addington. I believe this <br />response is adequate. <br />
