As requested, we have reviewed the information you <br />provided our office concerning the hydrologic consequences of the mine operation. <br />From this information, we have the following comments: <br />L 1. AL1 sediment ponds uwst bc-capable of releasing stored ,cater <br />in excess of: 2 acre-feet within thirty-six hours in accordance <br />with CRS 1973, 37-87-122(3). It appears that the 14ork area <br />Sediment Uttention Pond might not meet this requirement. If <br />the pond cannot meet this requirement, Colo,vyo will need a <br />- court approved augmentation plan to replace water stored out <br />of priority. <br />'~ 2. Water falling on the mined area ,which flows to the bottum of ~~~ar/~ <br />the pit must also be rcplacud when diverted out of priority. l ~„~~ ~~~ <br />Phis replacement must follow the guidelines of a court J <br />al~provcd augmentation plan. <br />~3` Pagu 2.04-32 of the application states that ground water <br />occurrence in the general area will not be affected by mining. <br />YJe believe that your staff should review the geologic data in <br />the application to assure this conclusion is correct and that <br />surrounding wells will not experience declining water table <br />clcv;ltions. <br />\.
