~~ <br />~` <br />Energy Fuels Corporation Special Stipulations <br />1. The applicant shall amend the blasting form to include directions to the <br />nearest building or occupied structure. A copy of the revised form must be <br />submitted to the regulatory authority 2 weeks after mine-plan approval. <br />2. The applicant shall relocate an existing air-quality monitor or install a <br />new one south-southwest of the Eckman Park mine area prior to commencement of <br />mining in that sector. <br />3. The applicant shall provide, by July 14, 1980, statistically valid <br />vegetative information associated with the soil type of the elk calving <br />ground, (soil type x8D). Ttie information must include production, cover, and <br />diversity of the area. A dissimilarity statistical analysis shall be <br />performed to demonstrate differences between the aspen communities on other <br />soil types in the mine plan area and comaunities on soil type x8D in the mine <br />plan area. <br />4. Within 2 months after the submission of the above requested vegetative <br />information required in special stipulation 3, the applicant shall provide to <br />the regulatory authority a detailed description of methodologies and criteria <br />used in establishing new calving areas. The applicant must also provide with <br />this submittal a detailed description of a monitoring program to evaluate the <br />success of the sew calving area. <br />5. Six months after approval, the applicant shall submit for approval of the <br />regulatory authority, a narrative of the techniques and devices to be used to <br />establish the necessary watering areas for elk. The plan shall also include a <br />map showing the location o.f the watering areas in relation [o the elk calving <br />grounds. <br />6: Every 6 months for the life of the mine, the applicant shall provide data <br />collected during elk monitoring programs to the regulatory authority. If it <br />becomes apparent through monitoring of elk movement that haul roads are <br />interfering with migration of the elk, the applicant shall use fencing <br />approved by the regulatory authority. The fencing shall be employed to <br />minimize impacts of roads during migration periods. <br />7. If any adverse impacts to fish or wildlife are discovered during the <br />proposed monitoring programs, the applicant must, in consultation with <br />regulatory authority, take appropriate measures to mitigate the impacts. <br />8. The applicant shall seed all disturbed areas that have reviewed final <br />topsoil pzepara[on during the first normal planting period (fall). The <br />applicant shall not delay seeding for the purpose of establishing a mulch <br />cover crop. <br />9. The applicant has proposed the use of statistical comparisons of <br />vegetation cover and production for establishing permanent reference areas. <br />A similar comparison to that used to identify and establish permanent <br />reference areas shall be used for measuring the success of tevegetatlon <br />(vegetation cover acid production) for bond release. Vegetation diversity will <br />be measured using the Shannon-Wiener index. Diversity component evaluations <br />will also be used in the determination of revegecation success. This <br />information will be submitted to the regulatory authority by September 1, <br />1980. <br /> <br />
