Leases C-22645, C-209OC, C-123<~3, D-05254£ ar.c C-152 c4 <br />The approval to mine a: the site(s) described in the referenced mine <br />plan is sub,ect to the following standard and special cenditions and <br />stipulations. This acproval shall be revocable at the discretion cf the <br />Cirector, Office of Surface Mining, if the operator fzils to comply wi*_h <br />any conditicn or stip::lation. The term "Regulatory Authority" as used <br />herein (including the Special Stipulations) means both the federal Office <br />of Surface P'ininc and the Colorado Mined Land Reclamation Bozrd unless <br />otherwise specified. <br />1. The eperator agrees to be bound by the provisions of Section 517 of <br />the Surface Mining Control and Reclamation Act of 1977, 30 USC 1267 (P.L. <br />95-c7, hereinzfter referred to as "Act"), and agrees to allow the authorized <br />representatives Ci the Secretary, v;ithout advance novice or z search <br />wzrrant, upon presentztion of zpproprizte credentials, and without delay, <br />tG: <br />A. Enter upon or *_hrough any surface coal miring znd reclamation operations <br />tc: <br />Inspect any coil mining and reclamation operation, monitoring <br />equipment, or ;,rocedure conducted pursuant *_o the permit; <br />2. Collect samples and other relevant informa'_ion regzrding air or <br />water, fish and wildlife, soils, vegetation and other resources <br />protected under the kct, this Chapter znd the State program; and, <br />~. Obtzin access to any copy of an1• records required to be maintained <br />under *_he terr:5 and Conditions cf the permit or the regulatory <br />prograa. <br />B. Be accompanied by private persons for the purpose of conducting zn <br />inspection in accordance v^th Section 521 (a) of the Act. <br />The term "authorized r?presentative of the Secretary" zs used in Section <br />517 and this paragraph shall be construes to include, bu*_ not be limi*_ed <br />to, employees of the United States who are supervised by, or detailed or <br />assigned to the Office of Surface Miring; any person under contract who <br />is acting er, behalf of the Secretary or any person employed by the State <br />Regulatory Authority if it is au*_horized to reeulate surface coil mininc <br />operations on federal lands; or any other person identified as an zuthcrized <br />representative by a letter signed by the Director, Office of Surface t•~ining. <br />2. The operator shall comply at all times wi*.h the provisions of *. he <br />Surface Mining Control and Reclamation Act of 1377, the Mineral Lensing <br />Act of 1920, as amended, and the rules and regulations promulgzted pursuant <br />to szid Acts, and such other requirements as the Pegulatory Authority <br />shall promulgate by rule. <br /> <br /> <br />
