816.101 <br />~~ <br />BACF.FILLING AND GRADI2dG: <br />v3,pp.81b-122 to 816-127 <br />`~ <br />GENERAL REQUIREMENTS (cont.) <br />The regulatory authority grants the additional time <br />necessary to backfill the northeastern end of the <br />8050 pits because the applicant has presented a <br />detailed written analysis persuant to 34CFR780.18(b)(3) <br />that demonstrates that additional time is necessary, <br />(v3,pp.616-124(a) to 81b-125(a), map 41. map 42. <br />map 57, pp.780-111 to 730-118). <br />The second eaceptioa is requested in the area of the <br />7400 pit near the western edge of the C-081330 <br />lease line. The applicant proposes to leave a portion <br />of the 7400 pit open for approximately one yeaz. <br />Mining will resume is this area in October 1980. The <br />Marion 7400 had to leave its mining area along the <br />western edge of EFC's present mining operation due to <br />its close proximity to the C-081330 lease line in <br />September 1979. As the BE770 Dragline finishes in <br />the area it is presently working it will be moved to <br />the pit left opened by the Marion 7400 Dragline. <br />To avoid backfilliag the present 7400 pit and bozcutting <br />it again in six months time which would cause additional <br />environmental damage, the regulatory authority grants <br />the applicant the additional time necessary to backfill <br />the 7400 pit near the western edge of the C-081330 <br />line because the applicant has presented a detailed. <br />written analysis persuant to 30CFR780.18(b)(3) that <br />demonstrates that additional time is necessary.
