<br />Preliminary Adequacy Review Comments <br />Legal, Financial and Compliance Information -Rule 2.03 <br />1. The applicant should compile a list of all names of persons and/or <br />organizations which collected and analyzed technical data. Additionally the <br />dates of collection and analyses and descriptions of the methodologies used to <br />collect and analyze the data should be provided. The applicant should also <br />compile a list of persons and their addresses and positions of each private or <br />academic research organization or governmental agency consulted in obtaining <br />information on land uses, soils, geology, vegetation, fish and wildlife, water <br />quantity and quality, air quality, and archeological cultural and historic <br />resources. <br />2. The applicant has provided a list of legal owners of record of the coal <br />to be mined, however, these owners of record have not been designated on an <br />appropriate subsurface ownership map. The applicant should submit such a map <br />to the Division. <br />3. The applicant should clarify whether applicant, partner, principle <br />shareholder or Storm King Mines has operated any surface coal mining operation <br />in the United States subsequent to 1970. The applicant should also state <br />whether Storm King Mines or any of the partners, shareholders, or applicants <br />have any permit applications pending for any surface coal mining operation in <br />the United States other than Coal Ridge No. 1. This information should be <br />listed by permit or application number and identify the regulatory authority <br />for each of those surface coal mining operations. <br />4. The applicant needs to provide additional compliance information. This <br />information should contain a schedule listing any and all Notices of <br />Violations of the Act and any applicable law of the United States or of this <br />State, or of any applicable rule or regulation of any department or agency of <br />the United States, other states, and this State, pertaining to air or water <br />environmental protection received by the applicant in connection with any <br />surface coal mining operations during the three year period prior to the date <br />of the application. With respect to the notices of violation cited in the <br />application by the applicant; the applicant should provide additional <br />information regarding the date, location and type of any administrative or <br />judicial proceedings initiated concerning the violation; including but not <br />limited to proceedings initiated by the applicant to obtain administrative or <br />judicial review of the violations; the current status of the proceedings; the <br />actions, if any, taken by the applicant to abate the violation; and the final <br />resolution of the notices of violation. <br />5. The applicant needs to provide a listing of all lease numbers and their <br />recorded location or a copy of each lease for all leases with owners of coa l <br />to be mined and surface owners of land to be affected within the permit area. <br />
