The applicant states on page 2.06-2 that no delay in contemporaneous reclamation as a <br />result of underground operations will occur. As such, the application is in compliance <br />with this section. <br />Rule 2.06.8 Surface Coal Mining and Reclamation Operations on Areas, or adjacent to <br />Areas, Includin~Alluviel Valley Floors <br />119. Applicants may affirmatively demonstrate in their application the presence of alluvial <br />valley floors (Section 2.06.8(3)(6)). If, however, applicants believe that certain stream- <br />holding valleys within and adjacent to the permit do not contain alluvial valley floors, the <br />applicant must provide the results of a field investigation to the Division, and the Division <br />(not the applicant) must then determine whether those stream-holding valleys contain <br />alluvial valley floors (2.06.8(3)(6)). (DIH) <br />Because of this regulatory procedure, the Division requests the following: <br />a) On page 2.06-2, change "In summary, Lorencito Canyon does not qualify as an <br />• AVF" to "In summary, Lorencito Canyon does not appeaz to contain any <br />AVFs";(DIH) <br />b) On page 2.06-2, change "Cow Canyon does not qualify as an AVF" to "Cow <br />Canyon does not appeaz to contain an AVF"; (DIH) <br />' ,0~5 <br />c) On page 2.06-3, change "Alamosa Canyon does not qualify as an AVF" to <br />O~ "Alamosa Canyon does not appeaz to contain an AVF"; (DIH) <br />d) On page 2.06-3, change "Chimney, Puertecito, and Jeff Canyons do not have <br />alluvial valley floors as defined by Surface Mining Control and Reclamation Act <br />(SMCRA)" to "Chimney, Puertecito, and Jeff Canyons do not appear to contain <br />an AVF". (DIH) <br />e) Similaz sentences appeaz in the conclusions section of Exhibit 18, "AVF Technical <br />Report." They should be similazly revised as well. (DIH) <br />120.
