topsoil from contow mining and from the disposal areas will be salvaged. If topsoil
stripping, salvaging, and replacement at the contow operations and at the disposal azeas
will occw in accordance with the plan described on pages 2.05-33 and 2.05-35 of the
application, a sentence may be placed on page 2.05-10 indicating this.
220.
72. On page 2.05-40, it is stated that "Underground development waste from fault crossings,
overcast development, or roof rock will either be deposited in underground gob rooms or
be placed in the surface mine backfill". By definition (1.04(22)) underground
development waste is also "coal mine waste". As such, Section 4.11.3 of the Regulations
allows underground development waste to be retwned to underground mine workings
("gob rooms") only in accordance with a waste disposal program approved by both the
Division and MSH.A under Section 2.05.3(a) of the Regulations. Please provide this
information. 7"'~q>
If the applicant, rather than placing underground development waste in underground
workings, would rather place this material in the proposed spoil fills, the information
required by Section 4.09.1(12) of the Regulations must be provided.
Rulc 2.05.3(31 Mine Facilities DGyv~~
. 73. 1t is stated in the second paragraph on page 2.05-10 that "Shale and other extraneous
be material separated from the coal prior to loading will be left in the pit or placed with the
overbwden." As the definition of "coal processing waste" (Rule 1.04{24)) is "earth
materials which are separated and wasted from product coal...", it could be construed
from this sentence that "processing" of coal will occur at the swface mine prior to being
trucked to the loadout facility. A description of the coal processing facility or equipment
planned at the swface mine would then be required. If processing is not intended,
however, then this sentence should be reworded.
It should be noted that Section 4.26.2(4)(c) of the Regulations requires the top of the
underbwden immediately below the lowest coal seam mined by mountaintop removal
methods to be covered with non-toxic spoil. If "shale and other extraneous material" will
be returned to the pit floor, those materials must be determined to be non-toxic prior to
A their placement.
(774.
