G~j;t. :;~ ..:: L:. .,, .~~~:::'fCCS <br />As part of an Apparent Completeness Review (ACR) for the Red Canyon Mine <br />(CO 0071), six comments concerning cultural resources were forwarded to your <br />office (Attachment OF1). On Friday, May 8, 1981 we were informed that your <br />office had not sent this part of the ACR to the applicant because of a <br />question in jurisdiction. Under the National Historic Preservation Act <br />(NHPA), the National Environmental Policy Act (NEPA) and the implementing <br />regulations, OSM is mandated to protect cultural resources on any area that <br />may be impacted by a Federal action. This protection extends to the surface <br />of lands above Federal coal, and to private and state lands and minerals that <br />may be impacted by the Federal approval of a mine plan. Attachment Ik2 is a <br />summary of the legislation, regulations, court decisions and other legal <br />opinions that support this position. <br />OSM is not in a position to comply with these laws and regulations until the <br />six concerns are adequately addressed by the applicant.
