G~j;t. :;~ ..:: L:. .,, .~~~:::'fCCS
As part of an Apparent Completeness Review (ACR) for the Red Canyon Mine
(CO 0071), six comments concerning cultural resources were forwarded to your
office (Attachment OF1). On Friday, May 8, 1981 we were informed that your
office had not sent this part of the ACR to the applicant because of a
question in jurisdiction. Under the National Historic Preservation Act
(NHPA), the National Environmental Policy Act (NEPA) and the implementing
regulations, OSM is mandated to protect cultural resources on any area that
may be impacted by a Federal action. This protection extends to the surface
of lands above Federal coal, and to private and state lands and minerals that
may be impacted by the Federal approval of a mine plan. Attachment Ik2 is a
summary of the legislation, regulations, court decisions and other legal
opinions that support this position.
OSM is not in a position to comply with these laws and regulations until the
six concerns are adequately addressed by the applicant. We therefore request
that you forward the attached comments to the applicant as soon as possible.
If you have further questions, please contact us.
Sincerely,
DONALD A.
