RE: Foidel Creek Permit Revision Application

Dear Mr. Damrau:
The above referenced application has been reviewed by the
Division of Mined Land Reclamation for compliance with the
Regulations promulgated pursuant to the Colorado Surface Coal
Mining Reclamation Act, C.R.S. 1973, 34-33-101, et sue. This
letter and attached comments convey the concerns raised durlnq
the adequacy review and constitutes the notification of
preliminary findings as required in Rule 2.07.4(1). Additional
information may be requested as the review continues.
The permit revision application waa delivered to the Office of
Surface Mining who subsequently requested comments from the
U.S. Fish and Wildlife Service (USFWS), the Minerals Management
Service (MMS) and the Bureau of Land Management Service (BLM).
The USFWS has no objections or comments and the MMS states that
the revision only addresses non-federal coal under non-federal
surface and the recoverability of adSacent Federal coal is not
expected to be affected. MMS, therefore offers no official
comment. The BLM has not yet responded.
The maSor deficiency in the permit revision application relates
to the impacts of the underground mine to the hydrologic
balance. Section VII of the attachment, Protection of the
Hydrological Balance, details the Division's concerns including
