2.06 REQUIREh1ENT5 FOR PERMITS FOR SPECIAL CATEGORIES OF F17NING <br />2.06.5 Prime Farmlands <br />The applicant must address this section. The SCS should be contacted for <br />their opinion. A copy of their response is requested. <br />2.06.8 Surface Coal Mining and Reclamation Operations on Areas, <br />or Rdiacent to Azeas, Including Alluvial valleu Floozs <br />Empire Energy Corporation submitted a request far exemption from the <br />Alluvial Valley Floor requirements on November 12, 1980.. The Division, <br />OSM and representatives of Empire Energy have met several times regarding <br />the AVF exemption. Attachment E details the Division's and OSM's position. <br />The geograhic extent of Mines No. 5 and No. 9 is tl~e remaining issue <br />to be resolved. Attachment E misty kenly states that the Division has <br />identified mine maps submitted to the Colorado Division of Mines for <br />Eagle Mine No. 9. In order to delineate t}~e geographic extent of <br />exemptions for the No. 9 mine, Empire Energ~7 must submit a map of the <br />Eagle Mine No. 9 filed prior to August 3, 1977 with a State, Federal of <br />Ioca1 government agency. <br />The Division must make a written finding pursuant to Rule 2.0G.5(2)(k) <br />that the applicant has satisfactorily addressed the requirements of the <br />Act and regulations. These requirements are specifically identified <br />in Attachment E under the Scope of Exemption. This information must be <br />submitted before the permit can be approved. <br />2.06.10 Coal Processing Plants and Support Facilities Not Located <br />within the Permit Area <br />The following comments pertain to the Craig loadout facility. The applicant <br />should address the timeframe involved with t1~e loadout facility and the <br />quantities of coal to be involved there. Additionally, the Moffat County <br />Planning Commission has requested updated information on Empire's situation <br />in Moffat County (see Attachment F). The applicant must demonstrate in <br />the application that the facility is in compliance with the applicable <br />performance standards. <br />The applicant should state when the signs and markers will be positioned <br />and that they are in compliance with Rule 4.02. <br />The applicant has stated that "D -RGW has requested that Empire miintain <br />the existing and pre-mining land use upon abandonment, Scc Appendix II-1." <br />Ifowever, Appendix SI-I contains fro sucJ~ request. Please include the <br />request with the application. <br />The operation and facilities, including roads are required to meet the <br />performance standards of Rules 9.03 and 4.09. The sediment control system <br />must meet the requirments of Rule 4.05.7. <br />The applicant makes reference to Map V-1 in the narrative, which should <br />show the facility. Jfowever, no map was provided. Please provide a map <br />prepared to the standards of Rule 2.10. The Division is required per <br />Rule 2.06.10(3), to make a written finding that the loadout facility is <br />operation i» compliance with the requirements of 4.28. <br />
