Shelton <br />Director <br />Re: Empire Energy Corporation, Preliminary Adequacy Review <br />File No. C-049-81 <br />Dear Mr. Schissler: <br />The purpose of this letter is to convey the preliminary concerns which <br />have been identified in the review of the application referenced above. <br />This review constitutes the 60-day notification of preliminary findings <br />as to the substantive adequacy of your application, pursuant to CRS 1973, <br />39-33-118(5). Additional comments may be forthcoming as the review <br />progresses on the issues raised in this letter and on of/ters that may <br />be identified. <br />Review of maximum coal recovery is pending. The USGS is handling this <br />section and comments should be forthcoming soon. A copy of their response <br />will be sent to you. <br />The Division expects to resolve all outstanding issues during the course <br />of this review particularly the groundwater monitoring plan, the AVF <br />exemption, the subsidence plan and the Craig loadout facility. <br />The groundwater monitoring plan is a major concern of the Division's. This <br />has been the topic of many discussions during the past year; a summary <br />of the meetings is found in Attachment C. The monitoring plan is <br />necessary to establish groundwater baseline conditions and to evaluate <br />the probable hydrologic consequences of mining. The Alluvial Valley <br />Floor (AVF) issue is another major concern which has been discussed in <br />many meetings. The Division's and OSM's concurrent position is enclosed <br />as Attachment E. The Division is concerned about subsidence at the <br />Eagle Mines, particularly with respect to the nVF, existing structures, <br />the complex hydrology of the area and the fact that tJiere is a history <br />of subsidence in the area.
