Addendum v is a z~esponse to the list of draft <br />stipulations given to Wyoming Fuel Company on October 22, 1981. The purpose <br />of the response is to satisfy as many of the draft stipulations as possible and <br />to commit to satisfaction of all others t•~ithin the specified time frame. <br />Wyorrung Fuel Company hopes that this will rcrluce any delays caused by the OSM <br />review and permitting process. This Division has attempted to assist Wyoming <br />Fuel Company in this reyard by re viet.~.iny the responses and making recommenda- <br />tions to you as to which of the stipulations have been satisfied and may be <br />deleted from the fin dings document. <br />Three stipulations were adder] and one was deleted since blyoming Fuel Company <br />received the draft stipulations. The c7eletec7 stipulation regarded Division <br />concerns associated with the proposed reclamation seed mix. This stipulation <br />was satisfied prior to the 'finalization' of the findings document. The first <br />of the stipulations added to the draft version is that absolute determination <br />of eligibility for nomination to the National Register of Historic Places for <br />two sites of questionable eligibility be done by OSM and Colorado State Historical <br />Preservation Office personnel. The two other stipulations added regard the <br />collection and reporting of monitoring data from ground water monitoring sites. <br />As Wyoming Fuel Company had not seen these stipulations prior to the sub- <br />mission of Addendum V, no attempt to address them is contained therein. <br />The numerical heading and method of satisfaction for those stipulations this <br />Division considers to be satisfied are yiven below: <br />6. Wyoming Fuel Company has reduced the grade of Diversion Ditch E in <br />order to reduce the desiyn velocity to a level considered non-erosive and to <br />thereby eliminate the need for riprap protection. <br />
