Dear Steve:
On November 2, 1981, this Division received a document titled Addendum V
from Wyoming Fuel Company. Addendum v is a z~esponse to the list of draft
stipulations given to Wyoming Fuel Company on October 22, 1981. The purpose
of the response is to satisfy as many of the draft stipulations as possible and
to commit to satisfaction of all others t•~ithin the specified time frame.
Wyorrung Fuel Company hopes that this will rcrluce any delays caused by the OSM
review and permitting process. This Division has attempted to assist Wyoming
Fuel Company in this reyard by re viet.~.iny the responses and making recommenda-
tions to you as to which of the stipulations have been satisfied and may be
deleted from the fin dings document.
Three stipulations were adder] and one was deleted since blyoming Fuel Company
received the draft stipulations. The c7eletec7 stipulation regarded Division
concerns associated with the proposed reclamation seed mix. This stipulation
was satisfied prior to the 'finalization' of the findings document. The first
of the stipulations added to the draft version is that absolute determination
of eligibility for nomination to the National Register of Historic Places for
two sites of questionable eligibility be done by OSM and Colorado State Historical
Preservation Office personnel. The two other stipulations added regard the
collection and reporting of monitoring data from ground water monitoring sites.
As Wyoming Fuel Company had not seen these stipulations prior to the sub-
mission of Addendum V, no attempt to address them is contained therein.
The numerical heading and method of satisfaction for those stipulations this
Division considers to be satisfied are yiven below:
6. Wyoming Fuel Company has reduced the grade of Diversion Ditch E in
order to reduce the desiyn velocity to a level considered non-erosive and to
thereby eliminate the need for riprap protection.
