Exhibit 8, attached, is a letter dated Septem- <br />ber 29, 1980 addressed to DCC from G. W. Klapwyk, Manager, <br />Grand Valley Water User's Association in Grand Junction, <br />Colorado. This Exhibit states that the Fruita mine site will <br />probably never receive water for agricultural development. <br />10. Exhibit 9, attached, is a letter dated October 28, <br />1980 addressed to DCC from N. W. Plummer, Regional Director <br />of the Water and Power Resources Service (Department of the <br />Interior) in Salt Lake City, Utah. This Exhibit states there <br />are no planned water development projects above the Govern- <br />ment Highline Canal which is below the Fruita mine site. <br />11. Exhibit 10, attached, is a partial copy of the <br />BLM's draft Environmental Assessment (EA) on DCC's pending <br />Preference Rights Lease Applications. This draft EA was <br />issued on November 14, 1980 by the BLM and has been the sub- <br />ject of a public hearing on December 16, 1980. This Exhibit, <br />as shown on the pages marked 15 and 16 show the BLM's un- <br />suitability review for AVF. The BLM assessment concludes <br />that "by applying the requirements of water availability <br />(amount needed for subirrigtion or flood irrigation), exclu- <br />sion of upland areas, and size limitations (isolated areas <br />larger than 10 acres): no alluvial valley floors have been <br />identified in the proposed lease area." A complete copy of <br />this draft EA should have been previously distributed to the <br />CMLR. <br />It should be noted that the authors of Exhibits 5, <br />6, 7, 8 and 9 were supplied by DCC with the OSP4 Alluvial Valley <br />Floor Guidelines to assist their review and comment upon this <br />matter. All respondents in these exhibits have personal <br />knowledge of the Fruita mines site. <br />DCC believes this documentation which is based upon <br />sound scientific data in the possession of the Division and <br />other state and federal agencies should support the Board's <br />advisory opinion that DCC's Fruita mines and the lands affected <br />by its operations are not in, adjacent to, or under an alluvial <br />valley floor. <br />DCC respectfully requests that your staff promptly <br />review this submission and take this request before the next <br />
