The Division is also concerned <br />• with the volume oCtraffic that will occur donne construction of the railroad spur. the loadout <br />faciliq. the portals and the support buildin_s. <br />Our concern is that during the consuuction and equipment mobilization phase of the <br />operation. [here may be a sufficient colunle of trattic entering and leap ins the highway at the <br />mine access road junction that the Stare Department of Hi~•h~ya~s (or Las Animas Cuunt~ ) <br />may request some modification ro the high~yav for the protection of public safety. Please <br />state whether the Colorado Department of Transportation. Based on inquires with <br />agencies. Las Animas Conran and the Colorado Department of Transportation are the Dole <br />groups with formal permitting actions. As of this date. both the Counq and CDOT <br />approvals have be?n received isee attached permit approvalsl. ~Uhile both croups were <br />concerned. no spzcific improvements to Highway ]2 have been required. <br />Section 4.0..x(! )1 f~(i) of the Board's Regulations requires a certification report be submitted <br />to the Division upon completion ofconstruction ofanv access road.
