RE: Pond B, Energy Mines 1, 2. and Eckman Park
Dear Mr. Saunders:

This letter is written as verification of the containment capability of Pond B.
Upon review of the information supplied to this Division on November 27, 1981
and January 6, 1981, all applicable requirements appear to have been satisfied.
The Division therefore finds that Pond B has been designed, constructed, and
maintains Co contain or treat the volume of water from active mining areas
which would result from a 10-year 24-hour precipitation event.
Additionally, as discussed during our meeting of March 8, 1982, Pond B appears
to appropriately qualify as a treatment facility within the regulatory framework
of Rule 4. Given this decision, it seems appropriate to revise pertinent material
in CYCC's permit to reflect this new designation. Such modification would
presumably involve minor word changes within the permit and on applicable maps.
Such.changea would qualify as a "minor revision" and should be submitted as such.
