Item 17a and b: Exhibit AB was modified to include specific triggers to move to <br />alternative monitoring program tiers and chart of proposed wells to participate in the <br />program. The house and shop located in Section 11, Brookside, utilizes municipal water <br />system as verified by Brookside town clerk, Renee Bolkema on July 17, 2007. <br />Item 17c: Kallie Bauer of Applegate Group evaluated the need for culverts in the <br />facilities area. Based on this evaluation, one culvert was designed for the location where <br />the south collection ditch crossed the mine haul road. Sheet 1, Site Drainage Map, within <br />the Drainage and Sediment Control Plan (Exhibit V) is revised to show the proposed <br />culvert. In addition, Map 12 Proposed Mine Facilities is similazly revised to show the <br />culvert. <br />Item 21: Kent Crofts of IME Consulting, recommended sweet clover remain in the <br />temporary seed mix because it quickly establishes in the azea and provides a good root <br />penetration system for erosion control. Mr. Crofts has guided the Southfield (Energy <br />Fuels Coal Inc) mine to successful reclamation and therefore, has experience regarding <br />reclamation seed mixes specific to Fremont County. <br />Item 22: Northfield selected to salvage and stockpile ten inches of surface plant medium <br />based on the soil survey data chazacterizing the soil horizons and chemistry. Field photos <br />indicate roots penetrate approximately six to eight inches of the surface on the site. Ten <br />inches will insure salvaging of the majority of the plant medium. Including 12 inches <br />will only increase the amount of sand and gravel in the seed mix, which is not conducive <br />to successful revegetation. Northfield did not intend to discard rocks and gravelly <br />material from the surface material but would have to consider segregation if more than 10 <br />inches of surface material was required by the Division. <br />Item 25: The vegetation survey is provided in Exhibit J. <br />Item 29: Methods and statistical demonstrations concerning the vegetation survey will <br />be provided in the baseline vegetation report. Permit text on page 2.05.4-14 and 2.05.4- <br />15 (rather than page 2.05.4-13) is revised to clarify methods and statistical <br />demonstrations to be used for the last two years (prior to final bond release) monitoring. <br />Item 32: The typo on 2.05.3-31 was corrected. Regarding determination of toxic and <br />acid forming properties of the portal development material, Northfield analyzed samples <br />of the representative rock strata from a core hole adjacent to the facilities area and decline <br />location. Data indicated that the materials are predominately non-acid forming. In <br />addition, exchangeable sodium percentage (ESP) and pH values aze within acceptable <br />ranges. Data is available in Exhibit AI and reflected in permit text pages 2.05.3-30 and <br />31. <br />Northfield anticipates that the portal excavation material will be within acceptable ranges <br />for both acid-forming and toxic parameters to allow use of the material as overburden in <br />the mine bench fill.
