A monitoring program to ensure that no damage is being done to the <br />hydrologic balance should be presented in the permit application for <br />approval and implementation. <br />Criteria for Approval of Permit Applications - Rule 2.07.6 <br />1. The applicant's permit area is within 100' of the outside right-of-way <br />of State Highway 160. The applicant must provide to the Division the <br />necessary approvals for operations within or adjacent to the <br />right-of-way. The operator must obtain the necessary approvals of the <br />authorities with jurisdiction over the state highway. The operator <br />must provide an opportunity for a public hearing at which the interests <br />of the public and affected landowners will be represented and <br />protected, as well as provide notice in a newspaper of general <br />circulation regarding the hearing. <br />2. The applicant must submit proof that all reclamation fees required by <br />30 CFR Chapter 7, Subchapter R have been paid for all coal mining <br />operations as required. <br />Bonding -Rule 3 <br />1. A detailed estimate of the cost of reclamation of the proposed mining <br />operation must be included in the reclamation plan portion of the <br />permit application. The estimated cost must be in an amount sufficient <br />to assure the completion of the approved reclamation plan if the work <br />had to be performed by the Board, through independent contractors. The <br />estimate must include supporting calculations show in sufficient detail <br />to allow the Division to verify the accuracy of the estimate. <br />/es <br />Doc. No. 7398 <br />
