-~•- <br />The applicant should provide information on how the coal conveyor system <br />passing over the river will be designed to prevent damage to water quality <br />of the North Fork from coal fines falling into the river from the conveyor <br />as the coal is transported from the silo to the load-out facility. <br />The applicant should provide detailed designs for the underground sumps <br />and describe how water collected in the sumps would be treated and discharged. <br />Access Roads - Rule 9.03.2 <br />For the portion of the mine access road leading from the proposed bath <br />house location to the portal entries, the applicant must either <br />demonstrate that this road meets all design criteria and specifications <br />under Rule 4.03.2, or that any alternative design criteria and specifications <br />will be as environmentally sound as and structurally stable as that <br />resulting from access roads complying with the requirements of 9.03.2, <br />based upon a thorough analytical demonstration by a qualified professional <br />engineer. <br />Stream Buffer Zones - Rule 9.05.18 <br />In order for the Division to grant a variance from the stream buffer zone <br />requirements of Rule 4.05.18, the applicant will need to show, preferably <br />on a map, all areas of proposed disturbance that fall within the 100' <br />zone upon completion of the Highway Department's river relocation project. <br />This map should delineate all areas which will be reclaimed by the Highway <br />Department and all remaining areas within the buffer zone that Bear Coal <br />Company will be responsible for reclaiminy. <br />Public Participation - Operating within 100 feet of a Public Road - <br />Ru1e 2.07.6.6(2) (d) (iv) <br />Since portions of the revised Bear permit area will be withih 100 feet <br />of the right of way of State Highway 133, the Division shall: <br />I. Require Bear Coal Company to obtain a written approval from the State <br />Highway Department. <br />2. Provide an opportunity for a public hearing in the locality of the <br />proposed operation for the purpose of determining whether the interests <br />of the public and affected landowners will be protected from the proposed <br />operations. <br />3. Provide notice in the North Fork Times of the public heariny at least <br />two weeks before the hearing. <br />9. Make a written finding based upon information received at the public <br />hearing within 30 days after the completion of the hearing a.s to whether <br />the interests of tl~c public and affected lanrowners will br_ protected <br />from the proposed operation. <br /> <br />
