_ (,, . <br />The Division recommends a number of revisions in the seed mix, as follows: <br />I. The introduced grasses, Agropyron elongatum (tall wheatgrass), and <br />Bromus hiebarsteinii (meddow brome) should be removed from the mix and <br />replaced by natives such as bluebunch wheatgrass (Agropyron spicatum or <br />Agropyron inerme) and mountain brome (Bromus marginatus) or documentation <br />must be provided indicating that these species are necessary to achieve <br />the postmining Land use. <br />2. Yellow sweet clover should be removed from the seed mix due to its <br />highly competitive tendencies. <br />3. Rubber rabbitbrush and big sagebrush should be eliminated from the <br />seed mix as neither is abundant in undisturbed, good condition ereece <br />loam soils and their competitive nature could inhibit establishment of <br />the desired herbaceous species. <br />9. The three remaining shrubs need only be included in the broadcast, <br />steep slope seed mixture and not in the drill seeding. <br />NPDES and Air Quality Permits - Rule 2.05.4(2)(b) <br />The application does contain copies of approved NPDES permits, however <br />all three pertain to discharge points for the existing Dear 1 and 2 <br />operations. The applicant must describe, for the proposed Bear No. 3 <br />operation, the steps to be taken to comply with the requirements of the <br />Clean Water Act and other applicable water quality laws and regulations, <br />or provide a copy of an approved permit or application for a permit. <br />In regards to compliance with the requirements of the Clean Air Act and <br />other applicable air quality laws and regulations, once the transfer <br />of Emission Permit No. C-12,197(FO) from Anchor Coal Company to Bear <br />Coal Company has been approved by the Colorado Department of Health, <br />a copy of the revised permit must be included in the application. <br />Fish and Wildlife Plan 2.05.6(2)(a)(i <br />The Fish and Wildlife Plan within the application provides a brief <br />description of measures which will be used to enhance fish and wildlife <br />resources within and adjacent to the permit area. In order to determine <br />if any additional fish or wildlife enhancement techniques such as shrub <br />stand clearing or stream habitat improvement may be required from other <br />federal or state agencies (CROW, USFS, BLM, OSM) prior to permit approval, <br />the applicant should contact the appropriate agencies having jurisdiction <br />over the fish and wildlife mitigation aspects of the operation. <br />Protection of Hydrological Balance - Rule 2.05.6(3) <br />The application must be amended to include a site-specific statement of <br />the probable hydrologic consequences of mining as required under Rule <br />2.05.6(3)(iv). This statement should include predictions of during- <br />operation and postmining effects of the Bear No. 3 operation (including <br />possible subsidence effects) upon surface and groundwater on the proposed <br />permit and adjacent areas. <br />w <br />
