_, ._ <br />Bear Coal Company has not provided a design drawing of the sediment pond <br />embankment. The Division requires cross-section as well as plan view <br />drawings of sediment ponds in order to verify compliance Keith design <br />requirements. The applicant must provide a pond design drawing showing: <br />1. An embankment cross-section showing: <br />a. all embankment dimensions and geometry, <br />b, elevations of the sediment and 10 year, 24 hour storm volume <br />storage, <br />c. elevations of the emergency spillway crest. <br />Use of an arbitrary datum is acceptable as long as the native surface <br />elevation is shown. <br />2. Front-view and plan view drawing of all discharge works, <br />3. The seal and signature of a registered professional engineer. <br />Topsoil Handling - Rule 2.03.5(5) <br />Page 2.05-29 of the application states that "topsoil will be removed <br />from those areas to be affected by the surface relocation" and in <br />addition indicates that topsoil will not be salvaged from previously <br />disturbed areas where topsoil is not available. These areas need to be <br />clearly identified, preferably on a map, in order to allow the Division <br />to accurately determine where within the proposed permit area topsoil <br />will or will not be salvaged. Additionally, the salvage depths and <br />volumes listed under this section of the application may need to be <br />revised in accordance with the concerns raised in the Soils Resource <br />Information section of this adequacy review. <br />Coal Processing Waste and Non-Coal Processing Waste - Rule 2.05.3(8) <br />Maps 9 and 10 show a rotary breaker facility for separating rock From <br />coal before being conveyed to the silo; however there is no discussion <br />in the application as to what will be done with this processing waste <br />once it is ejected from the breaker. The application must be amended <br />to describe how this material will be disposed of during the operation. <br />The application indicates that no material constituting coal processing <br />waste will be generated by the mining operation, based upon the analysis <br />of one roof and one floor material sample which shows that the sampled <br />material is non-combustible, non-toxic and non-acid-forming, thus <br />qualifying as non-coal processing waste. This level of sampling, however, <br />is not sufficient to determine that the sample results arc representative <br />of roof, floor, and interburden conditions which arc likely to he encountered <br />during the entire permit term. A demonstration, based upon sampling <br />and analysis of roof, floor, and interburden in sufficient detail to <br />develop a representative sample, that waste materials gr_neratcd Ly the <br />mining operation during the permit term are non-combustible, non-toxic, <br />and non-acid-forming wi1Z be required. <br /> <br />
