The
applicant has filed applications for emissions permits with the Air Pollution
Control Division - Colorado Department of Health for the mine and tipple facilities.
Copies of these applications have been provided and the permittee will provide
final permit copies to the Division as the Department of Health approves the permits.
The Division finds the operation to be ih compliance with the requirements of this
section.
XI. Topsoil - Rules 2.04.9, 2.05.3(5), 2.05.4(2)(d) and 9.16
The Division has reviewed the permit application for the information on soil
resources, topsoil removal, handling and respreading,,and pertinent performance
standards contained in Sections 4.7 (pages IV-50 - IV-51), Exhibit IV-Z0, and
pages 34-42 of the June 18, 1982 response.
Soils within the permit area range from deep sandy loams in the Del Agua Canyon to
rocky outcrops along ridges. All soil types to be disturbed are suitable for
reclamation, and of sufficient quantity to provide an average redistribution depth
of I4 inches.
In describing topsoil replacement and handling, the applicant states that topsoil
will be redistributed on backfilled and graded areas from areas where stripping
is taking place, with extra topsoil being placed in topsoil stockpiles. Table
V-3 (revised) indicates all topsoil to be replaced will be from topsoil stockpiles.
This is inconsistent with operations on i:he ground. It is therefore stipulated:
Stipulation No. 5:
THE PERMITTEE WILL REVISE TABLE V-3 TO REFLECT TOPSOIL HANDLING
AND STORAGE OPERATIONS AS THEY OCCUR ON THE GROUND. THE TABLE
SHALL PROJECT TOPSOIL VOLUPIES FROM EACH CUT FOR EACH PIT, AND WILL
INDICATE THE DISPOSITION OF EXCESS 1'OPS0ZL TO SPECIFIC TOPSOIL
STOCKPILES. IF THERE IS A DEFICIT, THE TABLE SHALL IDENTIFY WHICH
STOCKPILE TOPSOIL MATERIAL WILL COME FROM AND VOLUME TO BE REMOVED.
THIS TABLE WILL BE SUBMITTED TO AND APPROVED BY THE DIVISION WITHIN
60 DAYS AFTER PERMIT ISSUANCE.
The applicant has proposed to seed and mulch topsoil stockpiles which remain inactive
for more than 90 days. The applicant has not proposed a temporary stabilization
seed mix or mulching plan for these stockpiles. It is therefore stipulated that:
Stipulation No. 6:
GJITHIN 60 DAYS OF PERMIT ISSUANCE, THE PEP.MITTEE SHALL SUBMIT AND
HAVE APPROVED BY THE DIVISION A PLAN ADDRESSING THE MULCHING AND
SEEDING OF TOPSOIL STOCXPILES. THE MULCHING PLAN SHALL INCLUDE,
AT A MINIMUTI; TYPE OF MULCH, METHOD OF APPLICATION, AND RATE OF
APPLICATION. THE SEED MIX SHALL INCLUDE, AT A MINIMUM; SPECIES
TO BE SEEDED, RATES OF SEEDING FOR EACH SPECIES IN POUNDS P.L.S.j
ACRE, FIETHOD OF SEEDING, AND TIME OF SEEDING.
With the acceptance of these stipulations, the proposed operation is in compliance.
