A follow-up inspection was made to the previous inspection May 29, 19 <br />Meadows Pit. The permittee and operator's son, Monte Downare was I <br />inspection. <br />S INITIALS TAS <br />37 of the Chaparral <br />resent during the <br />2. An entrance sign was posted as required by Rule 3.1.12. This ins ector assisted Mr. <br />Downare in conducting a preliminary survey to establish the boundaries of the 9.7 acre permit <br />boundary. Instruments used during the survey were the following: Brunton compass, measuring <br />wheel, 100' measuring tape, and June 25, 1984 permit area map. Survey st kes were installed <br />in a number of locations as temporary boundary markers. However, Mr. D wnare will need to <br />install permanent boundary markers in order to bring the site into co pliance with Rule <br />3.1.12. Please see page 3 for corrective actions. <br />3. Results of the preliminary survey indicate that there are a total of .7 acres currently <br />disturbed of which 3.0 acres are outside the permit boundary. The operat r has permitted an <br />area of 9.7 acres of which 5.7 acres are disturbed and 4.0 acres remai undisturbed (see <br />attached map). Since there is mining disturbance outside the permit bo ndary the Division <br />will send the operator a Reason to Believe letter indicating a possible v olation for either <br />mining without a permit or failure to protect areas outside the permit bo ndary from damage. <br />The operator will be expected to appear before the Colorado Mine Land R clamation Board at <br />the August 20-21, 1997 Board Meeting to be held in Glenwood Springs. <br />If the Board does find that a violation has occurred, then the operator{ will have several <br />options in order to bring the site into compliance with the Colorado Mi,.}{Ile Land Reclamation <br />Act for the Extraction of Construction Materials. These "options" or cor ective actions are <br />listed below: <br />A. Submit an application for a conversion from a 110(2) Limited Impacts Permit to a 112 <br />Regular Operation Permit. <br />B. Submit a request for financial warranty release of at least 3 <br />Following approval of the release request, submit an application to amend <br />boundary to include the 3 unpermitted, disturbed acres. <br />In either case, the Division will recommend to the Board that the ope <br />actions no later than October 22, 1997.
