<br />III. COMMENTS -COMPLIANCE <br />i <br />q/~~. <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of Colorado DMG. Henry Bazbe <br />represented the operator. The purpose of the inspection was to get familiarized with the <br />mine site and operations. This inspector will be doing an occasional inspection at West <br />Elk and had not been at the site for seven yeazs. The entire mine site was visited, <br />including the main site, Sylvester Gulch, the north topsoil area, Lone Pine Gulch, the <br />train loadout and both water tank azeas. A unit train was being loaded during the <br />inspection. <br />All of the roads were traveled and were found to be in very good condition. The roads <br />were well maintained. <br />Mine ID signs were up at the appropriate locations and contained the correct information. <br />Topsoil Stoc files <br />No erosional problems wer-e observed at any of the topsoil stockpiles. Topsoil signs were <br />up. The operator was hydroseeding the main topsoil pile behind the two Sylvester Gulch <br />shafts. <br />All of the ponds were visited. No problems were observed with any of the embar-lanents. <br />All spillways were functional. The operator was preparing to repair the liner in the first <br />cell of pond MB-1. The operator has done some pond cleaning lately and plans to <br />continue this yeaz. A delta of sediment at the inlet to pond MB-2R needs to be removed. <br />Pond SG-1 had water to within 3 or 4 feet of the emergency spillway. The emergency <br />spillway will be concreted soon. The water in the pond was being used to supply the <br />
