III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />The ditch around the facilities area was clear; the ditch to pond DP-1 from the wash <br />plant area was stable. There was tamarisk around the DP-1 pond. Water level of 4 <br />feet below emergency discharge on DP-1. The pond was populated with rushes and <br />cattails. There was rabbit brush all over the dam and the area nearby. <br />The topsoil pile at the facilities area was well vegetated. At the B vent shaft nearby, <br />the gravel pad SAE drainage flows through straw bales which were in good <br />condition. There was some fresh sediment in the road ditches from a rainstorm the <br />night before the inspection. <br />Refuse pile RP-1 was well vegetated. There are large rocks installed on the surface <br />for wildlife habitat. The RP-1 pond was dry. The pond bottom was grown up with <br />Iambs quarter, a forb. The ditches to the pond -along both sides of the refuse pile - <br />were clear. <br />Pond 2/3 contained some water. The multi-celled ponds collect the great majority of <br />sediment in the upper cells with passive transfer to the main pond. <br />Pond 4 - an oversized pond that collects drainage from refuse pile 4 -had tamarisk <br />around the pond. The operator plans to begin a tamarisk eradication program this <br />fall. A double ditch around the base of the refuse pile feeds drainage to the pond. <br />Pond 5 contained about 2' of water. The spillway is a combined main/emergency <br />rip-rapped spillway. There was some vegetation on the dam. The dam was stable <br />with no sign of erosion. <br />The conveyer corridor to transfer station 2 is permitted as part of the haul road. <br />Therefore it is not a small area exemption. There was no coal at all beneath the <br />conveyer. The whole area was clean. <br />Pond SS-2 collects runoff from an old reclaimed laydown area and slot storage. The <br />pond was dry and stable. <br />
