• <br />MINE ID # OR PROSPECTING ID # M-89-029 <br />INSPECTION DATE 4/26/2001 <br />(Page 3) • <br />INSPECTOR'S INITIALS TAS <br />5. 3.5 Milae of River Disrupted: The operator has committed to a minumum setback of 100 feet <br />between the mine pit and St. Vrain Creek and between the mine pit and Boulder Creek. The 100- <br />foot setback is measured from the existing riverbank of these creeks. The 100-foot setback <br />requirement was evaluated during the site inspection. Several measurements were taken from <br />the exising pit edge to St. Vrain Creek and the distance measured was approximately 150 feet, <br />well in compliance with the existing commitment. <br />6. Conveyor System/Negative Impact: Review of the permit application does not reveal any <br />discussion regarding complaints or negative impacts from the conveyor system, as presented <br />in the Mine Plan, Exhibit D. (Please advise the Division and/or provide any supporting <br />correspondence if the assessment above is inaccurate). <br />7. Legislative Declaratioa: Legislative Declaration in Section 34-32.5-102(1) of the Colorado <br />Land Reclamation Act for the Extraction of Construction Materials states that "It is the <br />further intent of the general assembly ... to protect and promote the health, safety, and <br />general welfare of the people of this state." It is the policy of the Division of Minerals <br />& Geology to :respond to written citizen complaints within 30 days of receipt of the complaint <br />with a site inspection. A site inspection was conducted on April 26, 2001 in accordance with <br />Division poli•.y in order to determine if the operation is in compliance with the requirements <br />of the mining and reclamation plan and the Colorado Land Reclamation Act for the Extraction <br />of Construction Materials. <br />8. Conclusion's: The Division finds no problems at the Longmont Distel Operation at this time. <br />However, addi~:ional aerial and/or field inspections will be conducted to evaluate whether the <br />operator is in compliance with terms of the mine plan and reclamation plan of the original <br />permit and each successive amendment as well as requirements of the Colorado Land Reclamation <br />Act for the E:traction of Construction Materials.
