III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection The comments include discussion of observations made <br />during the inspection, Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspecUOn conducted by Kent Gorham of the Colorado Division of <br />Reclamation, Mining, and Safety (Division) This former mountaintop removal operation is in <br />the final stages of completing reclamation. The site has achieved a Phase I bond release for <br />most areas. Ground conditions on this day were snow-covered and thawing due to warm <br />afternoon temperatures. Ron Thompson of Peak Project Management accompanied me on <br />the inspection <br />Availability of Records <br />The public copy of the mine records is kept at the office of Peak Project Management (PPM), <br />The contact. address, and phone number for PPM is Ron Thompson, Peak Project <br />Management, 34115 County Road 20.8. Trinidad, CO 81082. 719-846-4975. Records were <br />found in compliance as detailed on page 2a of this report. Third quarter 2006 pond <br />inspection reports were at the engineer's office for certification that is required annually by <br />the coal rules. The public liability insurance certificate expires February 8, 2007. <br />Roads <br />The Jeff Canyon haul road was snow-covered, wet, and muddy in many places. The <br />approved post-mining land use is "industrial" for this road until it reaches the disturbed area <br />for support of the coal bed methane extraction activities ongoing on the Hill Ranch. <br />Hydrologic Balance <br />Access to all ponds at the site <br />was limited due to poor surface <br />conditions. Pond 9 and pond 8 <br />were holding water below the <br />lowest holes on the primary riser. <br />Both ponds were frozen and <br />snow-covered Cold <br />temperatures have limited runoff <br />to only a brief period in the <br />afternoon, if at all. Ditches have <br />been re-shaped site wide in <br />conjunction with temporary roads <br />that were used for seeding <br />activities. Final drainage ditches <br />have been cleaned of sediment <br />and touch-up work will continue <br />as weather allows <br />
