III. COMMENTS -COMPLIANCE <br />Below ate comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was an inspection of coal exploration sites located on Third Park private lands <br />conducted on October 9, 2007 by Mike Boulay of the DRMS. Dave Anderson of <br />Western-Fuels-Colorado (WFC) was present during the entire inspection. Weather <br />conditions were sunny and warm. Ground conditions were damp and there was some <br />ponding of water on access roads from recent rains prior to this inspection. However al] <br />reclaimed borehole locations were accessible. <br />The sites of 34 abandoned and reclaimed exploration holes drilled under NOI X-2006- <br />142-09 were inspected. The holes include the following list: <br />NHTP06P-98 to 113 <br />NHTP06P-115 <br />NHTP06P-121 to 123 <br />NHTP06P-125 to 127 <br />NHTPO6P-131 to 134 <br />The following were twin holes that were cored in proximity to the original exploration <br />hole: <br />NHTP06P-98C <br />NHTP06P-99C <br />NHTP06P-107C <br />NHTP06P-115C <br />NHTP06P-122C <br />NHTP06P-134C <br />Abandonment reports dated 2/27/07 were provided to the DRMS for each hole. <br />Abandonment sealant consisted of "Bore-Gel" and "Quick Gel" bentonite mixture <br />pumped through the drill string from the total depth to between 10 and 20 feet below <br />ground surface (bgs). After geophysical logging the holes were filled with 3/8" bentonite <br />chips and cuttings to 10 feet bgs. Sakrete was used to cement the top ten feet of the hole. <br />Standard aluminum surveyor caps with the hole number stamped in the cap were set in <br />the cement to mark each hole. One hole, NHTP06P-107 was drilled deep enough to <br />penetrate a confining layer. This hole was sealed with cement slurry from the bottom <br />(290 feet) to a depth of 145 feet bgs. Two sacks of 3/8 inch bentonite were added to the <br />top of the cement slurry then bentonite sealant and cuttings filled the remainder of the <br />hole to ten feet. Sakrete filled the hole from 10 feet to surface and a monument was set. <br />
