III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />On May 11, 1995 a partial inspection was conducted at the Golden Eagle: Mine. The <br />subject of this inspection was the subsidence issue at the Tatum residence. The <br />weather was mostly clear with cloudiness increasing toward the end of the day. <br />Present at the inspection, from the Office of Surface Mining was Kewal K.. Kolai and <br />Mike Rosenthal; from the Colorado Division of Minerals and Geology wars Jim <br />Pendleton and Randy Price; from Basin Resources were Larry Bennet and Ralph <br />Lopez and representing the Tatums was Carl Gerity. <br />At this inspection the Tatum residence was inspected for possible subsidence related <br />damage. The adobe structure has suffered water damage from the wetter than normal <br />spring. The last time this structure was inspected was February 1, 1995 and the <br />southeast facing wall appeared to have greatly degraded since this time. The damage <br />noted was from an improperly drained roof in the southeast corner of the residence. <br />Water flowing from the roof had been piping adobe mud from this wall. A small 6 inch <br />mud delta had formed on inside sill of the south window in the corner bedroom. Also, <br />adobe mud was observed to be washed out of the this wall on the comer of the <br />external buttressing wall. The adobe was still damp to the touch. This wall is bowing <br />outward at the second floor level. This is a load bearing wall and may fail if not <br />shored up and protected from additional saturation from the leaking roof. <br />The ceiling beams in the study (southeast corner 1 st floor) room appeared to be <br />sinking down into the east side adobe wall. The Latex paint on inside of the wall <br />around the ceiling beam was folded around the bottom of the beam. Water stains <br />were noted on the wooden ceiling indicating that water had been seeping down from <br />
