Such materials include liquid fuels (excluding liquefied. propane); <br />solvents, lubricants, coolants, reagents, pesticides, etc. Some of the mining operations we regulate , <br />occur in or above alluvial ground water systems adjacent to stream channels. Other operations may <br />be located in, near, or over porous or highly fractured rock strata that may connect with near by <br />aquifers. <br />The Minerals Rules and Regulations define an aquifer as, "... a geologic formation, group of <br />geologic formations, or part of a geologic formation containing sufficient saturated permeable <br />material that could yield a sufficient quantity of water that may be extracted and applied to a <br />beneficial use." <br />The Minerals Program is responsible for the protection of ground water, under the provisions of SB <br />181. <br />In order to fulfill our responsibility, it is necessary that the following Policy be instituted: <br />Where an aquifer, as .defined above, exists within the mining permit boundary or there is <br />connected to an aquifer at depth and the mining operation intends to use and/or store toxic or <br />hazardous materials within the mining permit azea, the Office must include the following <br />condition in all application approvals: <br />"A.reportable spill is a spill of any toxic or hazardous substance (including spills of <br />petroleum products) within the permit area reportable to any Division of the <br />Colorado Department of Public Health and the Environment, the national Response <br />Center, the Colorado Emergency Planning Commission, a local Emergency Planning <br />Commission, a local Emergency Planning Committee, or the State Oil Inspector. <br />The operator shall notify the Office of a reportable spill within the permit area using <br />the same timeframe required by the permit, license, notice, Act, Rule or Regulation <br />governing the reporting of the spill to.the appropriate agency. Notice of a reportable <br />spill shall be Faxed to: Minerals Program Supervisor, Division of Minerals and <br />Geology, FAX (303) 832-8106. The FAX shall include acall-back number of a <br />responsible company official for DMG staffto use as a contact." <br />
