III. COMMENTS -COMPLIANCE <br />Colowyo C-1981-019 <br />27 March 2006 <br />Pg 1/3 <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Colowyo Mine conducted by Jim Stark of CDMG. <br />The inspection was conducted on 27 March 2006. Tony Tennyson of CCC <br />accompanied me on the inspection. The mine was actively mining coal, hauling <br />coal to the Loadout and loading a train at the time of the inspection. The weather <br />was warm and sunny and much of the ground was muddy (with shady areas still <br />covered with snow). <br />Roads: -The access road and haul road to the Gossard Loadout is a paved road. <br />The road was well maintained and in good condition. <br />-The light-use road to the West Pit and East Taylor ponds was muddy and slightly <br />rusted at the time of the inspection. The road was still stable and overall in good <br />shape, given the conditions. <br />-The haul roads in the East and West pit areas were all well maintained and stable at <br />the time of the inspection. The roads were dry. No erosional problems were noted <br />on these roads. <br />-The light-use roads around the Gossard <br />maintained and in good condition. <br />The roads to the East Pit reclamation and <br />Loadout and to the rail loop were all well <br />around the East Pit reclamation were all <br />muddy at the time of the inspection, The roads were well maintained and stable at <br />the time of the inspection. No erosional problems were noted on these roads. <br />Hydrologic Balance: -Both of the wash bay concrete sumps were full at the time of <br />the inspection. These sumps flow into the wash bay presettling pond. The presettling <br />pond was discharging into the work area pond at the time of the inspection. The <br />presettling pond was well vegetated and the embankment was stable at the time of <br />the inspection. No erosional problems were noted on the pond embankment at the <br />time of the inspection. This is not an NPDES discharge point. <br />-The wash bay pond contained water several feet below the spillway and was not <br />discharging. This is a total containment pond and discharge triggers BTEX testing (in <br />addition to regular NPDES testing). The water from this pond is used for watering the <br />roads. The pond embankment was well vegetated and appeared stable at the time <br />of the inspection. No erosional problems were noted on the pond embankment at <br />the time of the inspection. <br />-The work area pond (NPDES 002A) contained water approximately 2 feet below the <br />discharge pipe and was not discharging. The pond embankment was well <br />vegetated and stable at the time of the inspection. No erosional problems were <br />noted on the embankment at the time of the inspection. <br />-Sump 2 contained water approximately two feet below the top at the time of the <br />inspection. The sump was stable at the time of the inspection, <br />
