III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DRMS. No one represented the <br />operator during the field inspection. <br />Unit Train Loadout <br />There have not been any changes to the site since the last inspection. The three entrance gates were <br />open. The paved entrance roads were in good condition and the mine ID signs were up at each <br />entrance. Surface disturbance markers were up but the loadout site could use more markers on the east <br />side to better define the disturbed azea boundary. The operator still has some steel rail and other debris <br />to remove from the demolition project. Other mine equipment was being stored on the train loadout <br />bench. <br />The sediment control system was operating properly. Collection and diversion ditches were <br />functioning properly, although some tree branches need to be removed from the upland diversion ditch <br />that goes from the east gate to the central diversion system. Also, there is a little dirt that should be <br />removed from the outlet of the culvert that takes water from the railroad track area to the sediment <br />pond. Irrigation water was flowing through the central diversion system. The diversion system's <br />ditches, culverts, berms and straw bales were all functioning properly. There was no water in the <br />sediment pond. The bin wall of the pond was stable. The sediment pond's upland diversion ditch and <br />culverts all had sufficient capacity. <br />On the extreme west side of the loadout area, the silt fence along the reclaimed spur line section could <br />use some repair. Mora surface disturbance markers are needed as well. <br />Higltwav Coal Stockpile <br />The coal has been removed from this site and the area has been temporarily covered in soil and, then, <br />seeded. The dirt entrance road was in good condition. The mine ID sign was up at the entrance and <br />surface disturbance mazkers were up around the site, although more markers could be put up along the <br />southern boundary. The cut slopes were well grassed and appeared to be stable. There were no <br />erosional problems with the cut slope or the flat azea. The sediment pond was dry. The straw bales <br />were up azound the west side culvert inlet. Thistle was sprayed on the west side. <br />Well Field <br />The dirt entrance road leading to the well field up Sylvester Gulch road was dry and passable. The <br />mine ID sign was up at the entrance and surface disturbance mazkers were up. There were no problems <br />with the pump house. The topsoil stockpile had a good vegetative cover, although thistle needs to be <br />sprayed. The topsoil sign was up. <br />
