III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />One additional maintenance item was noted. The outlet end of the culvert immediately <br />adjacent to the sediment pond inlet area had apparently been run over and slightly <br />compressed. The culvert needs to be restored to its original diameter. <br />All other components of the drainage and sediment control system appeared to be properly <br />maintained and functional. <br />It was noted that the "in ditch" collection sump located along the south side road ditch a <br />short distance up-gradient from the sediment pond was full of saturated coaly sediment. <br />The operator indicated they intended to clean out the sump this fall. They were aware that <br />care will need to be taken during handling and placement of the material to ensure that <br />there is no spillage or flow of the saturated material outside of the designated containment <br />area. <br />Water was being pumped from the mine and discharged to McClave Creek as allowed by <br />CDPS permit via the 42 inch culvert beneath the mine bench at the time of the inspection. <br />The discharge appeared clear where viewed at the culvert outlet, and appeared to be on the <br />order of 200 gpm. <br />2 <br />
