III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br />Minerals and Geology. This site is temporarily inactive due to the shutdown of the sister <br />operation Lorencito Canyon, #C-96-084. The inspection began late in the afternoon on May <br />6 and continued on May 7`". The weather was warm and breezy. This site received over two <br />feet of snow with additional rain in the month of April. Total moisture exceeded four inches <br />for the month. On this day, most of the site was free of snow cover. All areas were <br />accessible by foot or vehicle. <br />Availability of Records <br />The public copy of the mine records is kept at the office of Peak Project Management (PPM). <br />The contact, address, and phone number for PPM is Ron Thompson, Peak Project <br />Management, 34115 Gounty Road 20.8, Trinidad, CO 81082, 719-846-4975. All records <br />were found in compliance as detailed on page 2a of this report. <br />Roads <br />Road culverts were found clear and appeared to function normally during recent wet periods. <br />Any roads that were used during the month of April were rutted due to wet and muddy <br />conditions. Ruts were noted on the west mine access road, the RDA access road, and the <br />Pond 8 light use road. These roads should be bladed as conditions allow to restore drainage <br />and surfacing. <br />~drolooic Balance <br />All ponds and containments at the site held water. Pond 8 at the RDA was full to the top of <br />the primary riser. No flow or evidence of flow was noted through the emergency spillway <br />since the last inspection. Pond 7 contained water and covered the lowest three sets of <br />holes on the primary riser of a total of eight sets. The outlet gate was found closed. The <br />weir box at the outlet should be cleaned of debris and vegetation. Pond 4 held water to the <br />bottom of the small primary riser. This pond drains a portion of the Development Waste Pile. <br />Pond 6, a structure solely dedicated to the idle prep plant, held a small amount of water in <br />the bottom. The eastern-most West Mine containment held a significant amount of runoff <br />captured from the disturbed area. The far west containment held only a small puddle in the <br />bottom. The three containments near the refuse conveyor all held water and appeared <br />normal. Ditches and culverts throughout the site showed no evidence of damage or <br />malfunction during the recent runoff experienced at this site. Perimeter ditches along the <br />river were traversed and found in good condition. <br />
