III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado Division of Minerals and <br />Geology. Bill Beaz represented the operator. <br />Roads <br />The paved haul road and the graveled gob pile haul road were in very good condition. The road to the <br />upper water tank bench was in very good condition as well. Road ditches and culverts were functional. <br />Hydrology <br />The water level was just over the primary dischazge tube elevation at pond B. There was a black <br />colored delta of sediment at the inlet to pond B but the water in the pond did not appeaz to have any <br />sedimentation problems. Pond D was dry. Pond embankments appeazed to be stable and spillways <br />i were functional. <br />All of the culverts, ditches and sediment control bales azound the mine site were functional. However, <br />several culverts and bales will need some maintenance soon. The culvert at the top of the paved haul <br />road and the culvert leading to pond B at the bottom of the paved haul road will need some sediment <br />removed soon. The outlet of the culvert that drains into the east side of pond D needs some sediment <br />cleaned out as well. Some of the straw bales at the road culvert that go across the conveyor corridor <br />and some of the straw bales at. the pump house could use replacements soon. The operator replaced a <br />straw bale that had shifted out of place neaz the entrance to the mine site. <br />Facilities <br />The operator will be moving the longwall azound the beginning of May. During that time, the coal <br />stockpiles will be depleted. The move should take azound three weeks. <br />The operator is getting ready to construct the material storage shed neaz the main topsoil stockpile, <br />once Division approval is received. <br />There were no problems observed with fugitive dust from the facilities or from the coal haul trucks as <br />they left the mine site. The operator cut down some trees at the entrance to the mine site, in order to <br />improve visibility for the haul trucks leaving the site. There was no other disturbance of the vegetation <br />in that area. <br />
