• (Page 2) • <br />MINE ID ~ OR PROSPECTING ID #` M83-178 <br />INSPECTION DATE 06/01/94 INSPECTOR'S INITIALS RCO <br />OBSERVATIONS <br />This partial inspection was performed by the Division partly as part of its ongoing <br />monitoring and partly in response to the operator's request for assistance concerning a <br />number of items at the site. The operator was contacted about the inspection and was present <br />for it. <br />This ie a 9.8-acre permit area, located several miles north of the Town of Las Animas. The <br />permit area did not have its boundaries marked, but did display a sign at its entrance. The <br />files contain information describing the permit area boundaries, but the areas affected by <br />this operation did not appear to conform exactly to said description in the files. However, <br />it was estimated that the affected area did not exceed 9.8 acres.. This apparent discrepancy <br />will be addressed by the operator by submitting information as to the size of the affected <br />area, a map showing the locations of excavation, stockpiling, processing, future mining, etc. <br />The operator is reminded that, in the case of reconfiguring the shape of the 9.8-acre permit <br />area, all affected land and areas for future mining must be included, and any part of the old <br />permit to be excluded from the new, must have not been disturbed by their mining activities. <br />The reconfigured area will be confirmed by Division inspection. <br />If the total acreage to be included in the updated area does not exceed the 110 permit limit, <br />this change may be considered as a technical revision to the 110, or as a new application <br />(Minerals Rules have been revised and do not allow 110 permit amendments now). If the <br />operator wishes to increase the permitted acreage to 10.0 or more, a conversion to a 112 <br />permit is needed. This was discussed with the operator. <br />If the extent of the affected area turns out to exceed the 110 permit limit (greater than 9.9 <br />acres) then this will be considered as a possible violation and will be brought before the <br />Mined Land Reclamation Board. <br />The description of extent of current operations, referred to in paragraph 2, will be <br />accompanied by proof of having also marked the boundaries of the permit. For problems and <br />their corrective actions, see page 3. <br />The operator stated that the county wishes to continue operating this pit, due to its <br />convenient location and good gravel deposit. Operator also stated that a conversion to a 112 <br />permit is considered for the future. <br />Other features observed during the inspection included a level processing area, a highwall <br />15 ft high and 200 ft long to the northwest side, no structures and no weediness. No <br />reclamation has been performed yet. Mining is proceeding to the north. The highwall in this <br />pit is steep, but the pit is active, and kept secure when not operated. There is no <br />disturbance or activity on the northern portion of the permit area, ae it is defined in the <br />files.
