III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. Jim Stazk also <br />represented the Division. Basil Bear represented the operator during the records check. There was <br />snow at the west mine and at the higher elevations of the east mine. A recent snowmelt at the lower <br />elevations lefr very muddy conditions. <br />Facilities <br />The operator had been leasing out a portion of the facilities at the east mine. However, that lease has <br />ended so there was no activity at the east mine. There was no activity at the west mine. The gate was <br />closed but not locked. There was a lot of haul truck vaffic at the train loadout but no activity at the <br />highway coal stockpile. <br />There was no problem with fugitive dust at the train loadout or at the highway coal stockpile. There <br />were some coal fines at the envances to the train loadout facilities but it did not appear to be a <br />problem. <br />The warehouse structure at the shop bench is being disassembled and will be moved to the Bowie No. <br />2 Mine. The oil trap at the shop level needs to have the oil boom replaced. <br />Some mine equipment has been stored on the east end of the crusher/screener bench. <br />A fuel facility on skids has been placed at the train loadoutjust southeast of the grizzly. The azea <br />around the facility has been graveled. <br />The operator has removed some of the coal at the temporary coal stockpile at the east mine. <br />Hydroloey <br />There were no discharges of any ponds at Bowie No. 1. Ponds nos. 1, 2, 3 and 4 were dry, as were the <br />west ridge waste pile pond and the (rain loadout pond. The west mine pond and the highway coal <br />stockpile pond had water several feet below discharge. There was only a little water in the ROM pile <br />pond. Pond embankments appeazed to be stable. Pond spillways were functional. <br />The ditch that leads to the culvert below the temporary coal stockpile bench needs cleaning due to a <br />rock fall. The ditch is still functional for now. Also, at the train loadout, a straw bale is missing in front <br />
