III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />General Comments <br />This was a partial monthly inspection of portions of the Roadside Mine surface disturbance areas. Weather was <br />clear and cold; 1 to 3 inches of crusted snow covered most areas. There was no operator contact present. <br />Official mine status is active, although mining ceased in 1999. Most areas are in various stages of reclamation, <br />with the exception being the Unit Train Loadout, which has been approved for use as a materials storage and rail <br />loading site. Areas inspected included the South Portal Facilities and RSRDA, RSRDA Borrow Area, North <br />Decline reclaimed area, North Portal reclaimed area, reclaimed conveyor corridor, UTL area, and reclaimed <br />areas along Coal Creek. CRDA-1 and CRDA-2 refuse areas were viewed from the Coal Creek road, but were <br />not closely inspected. GPS readings were taken within the North Portal reclaimed area and a sketch map <br />delineating the boundaries of the primary reclamation parcels and prominent features was plotted. A copy of the <br />sketch map is attached to this report. <br />Roads <br />Primary roads were snow covered but passable; conditions have not changed appreciably since December <br />inspection. <br />Hvdrolocic Balance <br />Condition of drainage and sediment control structures, including sediment ponds, SAE structures, berms and <br />ditches appears to be essentially as described in the December complete inspection. CBA-1 Sump sediment <br />level is approximately 2 feet below outlet elevation, and cleanout is warranted. <br />PVC sediment level markers in Sediment Pond 11 have been destroyed, apparently by vandals using the <br />markers for target practice. The markers will need to be replaced. <br />Minewater Discharge Site 016 was discharging clear flow, approximately 290 gpm. <br />The settling or piping erosional features (holes) at the North Portal reclaimed area and the CBA-2 Borrow area <br />are as described in the December inspection report. Repairs are necessary at these locations. The three <br />holes along or adjacent to perimeter berms at the North Portal area are shown on the GPS map attached to this <br />report (black diamond symbols). <br />Backfillino and Gradino <br />No areas of slumping or significant erosion were evident; snow cover prevented detailed observations. <br />Processing Waste <br />RSRDA appeared to be stable; perimeter ditches and terrace drains were in good condition. The CRDA refuse <br />areas were not closely inspected, but conditions did not appear to have changed since the December inspection. <br />Maintenance is warranted on the riprap energy dissipators at the outlet ends of the CRDA-2 Upper <br />Diversion, to be completed this spring. <br />3 <br />
