SUMMARY OF OBSERVATIONS WHICH MAY BE USED TO DETERMINE
COMPLIANCE WITH CONTEMPORANEOUS RECLAMATION
REQUIREMENTS AT SURFACE COAL MINING OPERATIONS
Compliance with contemporaneous reclamation requirements for a surface mine can be
determined during an inspection by comparing on-the-ground conditions to:
tt the maximum number of spoil ridges (4) allowed by Rule 4.14.1(1)(c), or the
maximum number of spoil ridges approved in the permit application package.
tt the maximum amount of time (180 days) allowed by Rule 4.14.1(1)(c) or the
maximum time approved in the permit application package.
u the maximum area shown on a map or described in the narrative of the approved
permit application package that may be stripped of topsoil ahead of the pit.
tt the maximum area of graded spoil that may accumulate prior to topsoil
replacement, as approved in the permit application package.
tt the maximum amount of time between final grading of spoil and topsoil
O replacement approved in the permit application package.
u the time which may elapse between topsoil replacement and revegetation
operations, as required by Rule 4.15.3 (1) and/or the approved permit application
package.
Note: This guide describes a general approach to determining compliance with
reclamation requirements. Requirements for contemporaneous reclamation
may vary from site to site. There may have been variances from some
requirements approved, or more stringent requirements may apply.
