III. COMMENTS -COMPLIANCE <br />Beiow are comments on the inspection. The comments include discussion_of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />The operator was discharging water from Pond B. The water level in the pond was several feet above <br />the level of the primary discharge tube. The discharge, about 200 gpm, appeared to be in compliance. <br />In order to avoid erosional problems, the operator is going to place riprap in the ditch that receives this <br />discharge. The pond embankment appeared to be stable. <br />Coal Waste Stockpiles <br />The haul road to the two coal waste piles was very muddy but passable. The road berm was functional; <br />as were the road ditches. No new additions have been made to the coal waste pile no. 1, which was <br />covered in snow. Topsoil stockpiles were also covered in snow. The water level in Pond C was several <br />feet above the level of the primary discharge tube. The operator was going to begin discharge of this <br />pond. The water level in Pond D was just above the primary discharge tube. <br />There was no activity at the coal waste pile no. 2. Since the last inspection, the operator has drained <br />most of the very small pools of standing water that were on top of the pile. The drainage channel in the <br />back of the pile could be better defined. Snowmelt water was draining off of the top of the pile and off <br />of the first bench and into Pond F. The operator is installing a pump system as the primary discharge <br />structure for Pond F. The discharge will go into the undershoot of the Fire Mountain Canal. The <br />riprapped ditches leading to Pond F were functional. Snow covered the coverfill stockpile and drainage <br />ditches. <br />Unit Train Loadout <br />A unit train was being loaded during the inspection. The Loadout process was very smooth and there <br />were no signs of fugitive dust in the immediate vicinity of the Loadout bin and the railroad tracks, even <br />though the ground was covered in snow. There were no signs of slumping or erosion on the snow- <br />covered bench outslope. The bench berm was functional. Culverts and ditches were covered in snow. <br />There was only snow in Pond 7. Pond K had a very small amount of water and some snow in it. The <br />spillways for both ponds were functional and the pond embankments were stable. <br />Records <br />The records were in compliance.
